Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Listingator.com (“we”, “us”, “our”, the “Service”). By registering or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

Service provider and Data Controller: Oleksandr Dordiuk, conducting business activity under the name “Listingator – Oleksandr Dordiuk”, operating the online service Listingator.com, entered in the Central Registration and Information on Economic Activity (CEIDG) register, Poland.

2. Eligibility and account

• You must be at least 16 years old to use the Service.
• You are responsible for providing accurate information, safeguarding your password, and maintaining account security.
• We may suspend or terminate access if you violate these Terms or pose security risks.

3. Scope of functionality

The Service provides features for managing Etsy product listings:

• Listings management: creating, editing, deleting, and storing listings with one image and basic fields (title, description, price, quantity, tags, product type, listing status).
• Templates: saving listing templates for quick creation of similar listings.
• Categories: organizing listings by categories.
• Bulk operations: duplicate, delete multiple listings at once.
• CSV export: exporting your listings data.
• Search & filters: finding listings by title, tags, price, status, etc.

At this time, there is no direct Etsy API integration. You manage your listing information here and manually publish to Etsy.

4. Subscription plans and payments

The Service offers both free and paid subscription plans:

• Free Plan: limited to 10 listings and 1 template. No credit card required.
• Paid Plans: starting from $5/month, offering increased limits on listings and templates. All features are available on all plans.

Billing and Payment Processing:

• Payments are processed securely by Stripe, our third-party payment provider.
• Subscriptions are billed on a monthly recurring basis unless cancelled.
• Prices are listed in USD and may be subject to applicable taxes depending on your location.
• You authorize us (via Stripe) to charge your payment method automatically each billing period.
• If a payment fails, we may suspend your access to paid features until payment is resolved.

Plan Limits:

• Each plan has limits on the number of listings and templates you can create.
• If you reach your limit, you must upgrade to a higher plan or delete existing items to create new ones.
• Downgrading to a plan with lower limits may require you to delete items exceeding the new limit.

Changes to Pricing:

• We may change subscription prices with at least 30 days' notice.
• Price changes will apply at your next renewal date.
• If you do not agree to the new pricing, you may cancel your subscription before the renewal date.

5. Cancellation and refunds

• Cancellation: You may cancel your paid subscription at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of your current billing period.
• Access after cancellation: After cancellation, you retain access to paid features until the end of your billing period, then your account reverts to the Free plan.
• Refunds: We do not offer refunds for partial months or unused portions of your subscription. All payments are final and non-refundable except where required by law.
• Free trial (if applicable): If we offer a free trial, you may cancel before the trial ends to avoid being charged. If you do not cancel, your payment method will be charged automatically.

6. User content

• You retain rights to your own content (texts, images, listing data) added to the Service.
• By providing content, you grant us a non-exclusive, revocable, royalty-free license to store and technically process it for the purpose of operating the Service.
• You warrant that you have rights to the content and that it does not violate laws or third-party rights.

7. Acceptable use

• You may not use the Service for unlawful activity, spam, malware, security circumvention, or IP infringement.
• You may not reverse engineer, bypass technical restrictions, or perform automated mass data scraping (except through official APIs, if provided).

8. Privacy

Processing of personal data is described in our Privacy Policy. By using the Service, you agree to that Policy.

9. Availability, changes, and maintenance

• We strive for continuous availability but do not guarantee error-free or uninterrupted operation.
• We may change or discontinue parts of the functionality (especially during MVP) with or without notice.
• We may perform scheduled maintenance that temporarily limits access.

10. Intellectual property

• The Service, its code, and design belong to us or our licensors. All rights reserved.
• “Listingator” and Listingator.com are used as the designation of the online service. We do not claim a registered trademark unless explicitly stated.
• You receive no IP rights other than a limited license to use the Service under these Terms.

11. Third-party services

The Service relies on third-party providers:

• Stripe — payment processing and subscription management
• Supabase — database, authentication, and file storage
• Vercel — hosting and analytics

We are not responsible for third-party services but select them with due care. Your use of payment services is subject to Stripe's Terms of Service.

12. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all express or implied warranties of merchantability, non-infringement, or fitness for a particular purpose.

13. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, punitive, special, or consequential damages, or loss of profits or data. Our total liability for all claims related to the Service is limited to the amount you actually paid us in the last 3 months (or 0, if none). Nothing in these Terms limits liability that cannot be limited by law.

14. Termination

• By you: You may stop using the Service at any time and delete your account. If you have a paid subscription, cancel it first to avoid future charges.
• By us: We may suspend or terminate your access if you violate these Terms, fail to pay subscription fees, or create risks for the Service or other users.
• Effect of termination: Upon termination, your right to use the Service ceases. We may delete your data according to our retention policies (see Privacy Policy).
• Surviving provisions: Sections regarding IP rights, disclaimers, liability limitations, and dispute resolution survive termination.

15. Governing law and jurisdiction

These Terms are governed by the laws of Poland and the European Union. Any disputes shall be resolved in the competent courts of Wrocław, Poland, unless mandatory consumer protection laws of your country provide otherwise.

16. Changes to these Terms

We may update these Terms. The new version takes effect upon publication on this page. For material changes, we will notify you in the app or by email.

17. Miscellaneous

• Severability: if any provision is invalid, the rest remain in force.
• No waiver: failure to enforce a provision does not constitute waiver.
• Force majeure: we are not liable for delays or failures caused by events beyond our control.
• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
